One Year Limited Warranty: B&D Rollers of Minnesota, Inc. (“B&D”) provides the following limited warranty to the original end-user purchaser (“Purchaser”) of THE CRUSHER® forage crop conditioning rollers (hereinafter the “Rollers”). B&D warrants the Rollers for a period of one (1) year from the date of purchase (the “Warranty Period”) against defects in the materials and workmanship of the Rollers under normal use and service. This Limited Warranty extends to normal use of the Rollers for conditioning forage crops only and will be void if the Rollers have been subject to misuse, accident, negligence, alteration, vandalism, freight damage or from improper operation, maintenance, alignment, installation, modification, or adjustment. Purchaser is responsible for shipping costs of repaired or replacement Rollers and the cost associated with removal of defective Rollers and re-installation of the repaired or replacement Rollers, regardless of the cause. This Limited Warranty represents the only warranty authorized and issued by B&D, and there are no warranties which extend beyond those expressed in this Limited Warranty.
How to Make a Claim: In the event Purchaser has a claim under this Limited Warranty during the Warranty Period, Purchaser may contact B&D by telephone at (320) 634-5115, by fax at (320) 634-5422, or by email at [email protected], or by mail at 1430 2nd Street, N.E. Glenwood, MN 56334, with the following information: Purchaser’s name, address, telephone number, date of purchase of the Rollers or equipment on which the Rollers are installed, and a description of the problem. If the description of the problem appears to be one covered by the Limited Warranty, Purchaser will be provided with a claim number and shipping instructions.
Remedy: B&D will make the final determination with regard to any claims made under this Limited Warranty. If the Rollers are determined by B&D, in its sole discretion, to be defective in materials or workmanship for whatever reason, B&D will, at its option and sole discretion, repair or replace the defective Rollers. B&D reserves the right to inspect all Rollers for which a Limited Warranty claim is made.
This Limited Warranty is in lieu of any other warranties, express or implied, and B&D specifically disclaims any implied warranty of merchantability or fitness for a particular purpose and the warranty of non-infringement of intellectual property rights, and is in lieu of any other obligation or liability on the part of B&D, whether a claim is based upon negligence, breach of warranty, or any other theory or cause of action. In no event shall B&D be liable for any consequential, incidental, indirect, special or punitive damages of any kind. No Rollers shall be deemed to be defective by reason of normal wear and tear, failure to properly store, install, operate, or maintain the Rollers or the implement on which the Rollers are installed, in accordance with good industry practices or specific recommendations of B&D or the implement manufacturer, including, but not limited to B&D’s and/or such implement manufacturer’s installation and operation manuals.
Rights Under State Law: Legal rights under state law with respect to this Limited Warranty vary from state to state. Some states do not allow exclusions of incidental or consequential damages, so the above exclusions may not apply. Other rights may vary from state to state depending on applicable law. Effective January 1, 2024.
